Our Terms of Use

1. Liability for Damage:

  • The company is not responsible for any leakage, shortage, breakage, or damage caused by rain, fire, or weather conditions, with the sender being accountable for proper packing.

2. Risk Acknowledgment for Fresh Fruits:

  • Fresh fruits are transported at the consignor's absolute risk, recognizing the possibility of spoilage during transit.

 

3. Dispatch and Delivery:

  • Goods will be dispatched promptly, either in one lot or in parts for convenience.

  • Delivery occurs at the company's godown or, upon request, at the consignee's office.

4. Immediate Acceptance:

  • Goods must be accepted immediately upon the truck's arrival at the site.

5. Claims and Responsibility:

  • Claims related to goods receipt must be submitted within two days; otherwise, they will not be entertained.

  • The company disclaims responsibility for delays or losses due to accidents, strikes, or factors beyond its control.

  • Claims will not be considered once delivery and receipts are completed.

6. Value Assessment and Additional Charges:

  • The company holds no responsibility if octroi or customs authorities assess the goods at a higher value.

  • In case of any variance in weight, charges will be based on the actual weight found, plus an additional 25% to cover discrepancies.

7. Notification of Non-Arrival:

  • Non-arrival of goods within one month must be notified; otherwise, the company is not liable for subsequent claims.

8. Storage and Discharge:

  • If the consignee fails to take delivery within fifteen days, the company reserves the right to discharge or place the goods in a public auction.

  • The sender is held responsible for any arrears due to the company after deducting the sale proceeds of the goods.

9. Insurance and Disputes:

  • Consignors must insure goods for transit risks like fire and theft.

  • Disputes about the Goods Receipt are subject to Palghar Jurisdiction and, if unresolved, to arbitration under the Indian Arbitration Act.

10. Accessibility and Insurance Requirement:

  • In locations inaccessible to trucks, the consignee must accept goods at the nearest accessible place by paying full freight to the driver.

  • Goods valued above Rs. 100 must be insured; otherwise, the company disclaims responsibility.
